Soft and Sound Terms and Conditions
Unless stated separately on an Individual event page these terms and conditions will apply.
For other event organisers individual terms and conditions please view their event pages and/or their website or contact the venue owner directly.
By using Softandsound.org, also referred to as the “website”, or the “site” all visitors, referred to as “User”, “You” or “Your” are bound by these terms and conditions.
The terms “we”, “us”, and “our” refer to Kate Sandel or Soft and Sound. This includes lessons in person and clinics, as well as the membership and premium coaching courses.
Accessing this Site, attending clinics or lessons constitutes a use of the site & an acceptance to the terms provided herein.
Use of the Site
You may use the Site for lawful purposes only. You shall not post or transmit through the Site any material which violates or infringes the rights of others, or which is threatening, abusive, defamatory, libellous, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law.
Unless otherwise stated, copyright of all articles, blogs, information and materials found on softandsound.org belongs solely to Kate Sandel, Soft and Sound.
You may not reproduce or redistribute the articles, blogs, information, and materials found on softandsound.org without the express written permission of Kate Sandel, Soft and Sound. Furthermore, the Site contains intellectual property owned by Kate Sandel, Soft and Sound including, without limitation, trademarks, copyrights, proprietary information and other intellectual property as well as the Soft and Sound name, logo, all designs, written text, graphics, other files. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Site content or intellectual property, in whole or in part without our prior written consent.
Softandsound.org may offer goods or services (“products”) for sale on behalf of Kate Sandel, Soft and Sound.
By placing an order through softandsound.org you are offering to purchase a product on and subject to these Terms and Conditions. All orders are subject to availability. Delivery times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which Kate Sandel, Soft and Sound. will not be responsible. In order to contract with Kate Sandel, Soft and Sound through softandsund.org you must be over 18 years of age and possess either an account with Paypal or a valid credit or debit card issued by a bank acceptable to us.
Kate Sandel, Soft and Sound and softandsound.org retain the right to refuse any request made by you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the Paypal account or credit or debit card used to place your order and that there are sufficient funds to cover the cost of the product(s). All prices advertised are subject to such changes. Prior to placing any order you will be asked to accept these terms and conditions. A contract between us will be formed after have purchased a service or product through our site, bound by these terms and conditions.
Once a lesson or clinic slot is booked no refunds will be given, but another person may be found to take on the cost of the lessons. It is the responsibility of the customer to find a replacement, rider but we will always support with this if we can.
In some circumstances we will transfer your booking to another date, please get in touch to discuss.
Soft and Sound cancellation for lessons or clinics. As much notice as possible if I need to cancel and will offer a refund and/or alternative dates.
If lessons or clinics are booked in an outdoor venue, they will go ahead unless there are serious weather warnings issues.
In the event of a Postponement:
A new date will be set which your entry will automatically be transferred to and you will be notified via email.
If you inform us you cannot attend we will return your money.
Alternatively a number of dates will be given to you where your entry can be transferred to.
Clinic or lesson Relocation
The Organiser has the right to change the location of the event due to unforeseen circumstances. In this situation our withdrawal policy remains the same.
Event – Refunds
Once a refund has been confirmed please allow 10 working days for your money to be refunded.
Clinics and Lessons Terms and Conditions
1. Horse/Pony sports are dangerous. Neither Kate Sandel, Soft and Sound nor any persons acting on their behalf, nor the landowner can accept any liability for loss, damage, accident or injury to any persons, horses or property.
2. It is compulsory that all riders wear hats/helmets up to British Standard Riding Hats conforming to All PAS 015, VG1 – provided they are BSI Kitemarked, European – VG1 – provided they are BSI Kitemarked American –All SEI ASTM F1163 04a onwards and SNELL E2001 Australian & New Zealand – AS/NZS 3838 2006 onwards. All Hats must carry a Horse-Events Tag or 2018 British Eventing/PC or RC tag.
3. It is compulsory that every person entering upon the event venue who is under the age of 18 years of age is accompanied by a responsible adult.
4. The Management of the venue reserves the right to remove anyone from the event at any time without giving a reason.
5. All our events may be cancelled without notice due to adverse weather. In the event of adverse weather it is recommended that you check the website or witty the event venue before departing.
6. Clinics outside of Regular Devon clinics. The clinic host is responsible for organising payments from riders, and gets a free lesson per day in exchange for hosting . It is up to the clinic host to organise times for all the riders and work with the riders to find replacements for their lessons if they are not able to attend. The clinic host may decide to charge an administration fee to the riders for their time.
Events – Health and Safety – at all Events
Kate Sandel, Soft and Sound have taken reasonable precautions to ensure the health and safety of everyone present. For these measures to be effective everyone must take all reasonable precautions to avoid and prevent accidents occurring, and must obey the rules and instructions of the organisers.
Events – Personal Injury and Insurance Notice
Kate Sandel, Soft and Sound does not insure the rider, your horse or your tack and equipment. You are strongly advised to have in place your own adequate horse and personal accident insurance at all times.
The Venue, Kate Sandel, Soft and Sound will not be held responsible for any accident, injury or loss to any person or their property however this may be caused.
Photography & Social Media
Please note that we may have photographers present at all our events which may be used on our social media platforms or for marketing purposes.

Limitation of Liability
We will do our best to ensure all facts and statements on this site and in our materials are true and correct to the best of our knowledge. We will do our best to ensure all facts and statements in our work do not infringe upon any copyright or other right of a third party. However, Kate Sandel, Soft and Sound can’t be liable to you, or any third party, for damages, including lost profits, lost savings, complaints, claims, litigation or other incidental, consequential or special damages which may arise from your use of softandsound.org or your relationship with Kate Sandel, Soft and Sound. The foregoing applies even if Soft and Sound was advised of the possibility of or could have foreseen the damages. In those jurisdictions that do not allow the exclusion or limitation of liability for damages, liability is limited to the fullest possible extent permitted by law.

The Site may contain links to third party websites and resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content or policies of third party websites or resources. Links to such websites or resources do not imply any endorsement by or affiliation with Kate Sandel, Soft and Sound or softandsound.org.
You shall indemnify and hold us harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments and expenses, as well as third party claims and causes of action, including, without limitation, attorneys’ fees, arising out of any breach by you of any of these Terms and Conditions, or any use by you of the Site. You shall provide us with such assistance, without charge, as we may request in connection with any such defence, including, without limitation, providing us with such information, documents, records and reasonable access to you, as we deem necessary. You shall not settle any third party claim or waive any defence without our prior written consent.
The owners and operators of softandsound.org may revise these Terms and Conditions from time to time so please check back regularly to ensure you are familiar with the current version.
If any provision of these terms and conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
